Trespass  is  an  illegal  entrance  into  another  person’s  immovable  property  to  violate  the  peaceful  living  of  the  people  in  there.  If  you  are  allowed  to  go  in  there,  it  will  never  be  an  offence.  That  is  why  the  offence  is  compoundable.  Though  the  damaged  person  has  lodged  a  complaint  with  police  against  you  or  has  prosecuted  you  in  the  court,  he/she  can  withdraw  the  complaint  or  withdraw  the  prosecution  and,  then  you  will  be  free  of  the  offence.

 

If  you  remove  the  boundary  mark  of  the  land  to  gain  the  ownership  of  the  part,  you  will  be  guilty  of  trespass  also,  punishable  with  imprisonment  not  more  than  three  years  and  fine  not  exceeding  six  thousand  baht.

 

If  the  trespass  is  committed  forcefully  or  by  two  or  more  person  or  at  night,  the  imprisonment  is  as  high  as  five  years  and  the  offence  is  not  compoundable.
