Offences relating to property, like the law of most other countries, consist of several instances:
1. Taking away another person’s property dishonestly is guilty of stealing, punishable with imprisonment not more than three years and fine not more than six thousand baht.
If the stealing is committed in an aggravated environment, such as stealing at night or in the place of fire or breaking a barricade or climbing in the window or disguising himself or impersonating another person etc., the punishment for that is heavier. However, if the stealing is committed because of necessity or uncontrollable poverty and the property is of small value, the court may impose punishment on the offender with a lower punishment than that prescribed by law.
If stealing committed by taking away in presence of the damaged person, it is called snatching, the punishment is heavier than a normal theft.
If stealing is committed by using force or threatening to use force, it is called robbery, punishable with much higher imprisonment – from five years to file imprisonment depending upon the degree of aggravation of the act, and;
If the robbery is committed by three or more person, it is called gang – robbery, the punishment for that is much higher, probably life imprisonment or death, depending upon the act or its result.
